Seller Agreement

This Seller Agreement is a binding contract between you and Declutra. You must accept this agreement before publishing any listings on the Declutra marketplace. This agreement is in addition to the Declutra Terms of Service.

1. Agreement to Terms

By publishing listings on the Declutra marketplace, you agree to be bound by this Seller Agreement in addition to the Declutra Terms of Service. If there is a conflict between this Seller Agreement and the Terms of Service, this Seller Agreement shall govern with respect to your activities as a seller.

2. Seller Representations & Warranties

By listing items on the Declutra marketplace, you represent and warrant that:

  • You own, or have the legal right to sell, all items you list on the marketplace.
  • All information in your listings, including descriptions, photos, condition ratings, and pricing, is accurate, complete, and not misleading.
  • The sale of the listed items complies with all applicable federal, state, and local laws and regulations.
  • You hold all necessary permits, licenses, and authorizations required to sell the listed items.
  • Your listings do not infringe upon the intellectual property rights of any third party.

3. Listing Standards

All listings on the Declutra marketplace must meet the following standards:

  • Include clear, accurate photos of the actual item being sold.
  • Provide honest, detailed descriptions including any defects, damage, or wear.
  • Set fair pricing that reflects the item's condition and market value.
  • Do not post misleading, deceptive, or fraudulent listings.

Listings that do not meet these standards may be removed without notice. Repeated violations will result in account suspension or termination.

4. Prohibited Items

You agree not to list any items prohibited by the Declutra Prohibited Items Policy. It is your responsibility to review and comply with the prohibited items policy before listing any item. Listing prohibited items is grounds for immediate account termination.

5. Transaction Responsibility

As a seller, you are solely responsible for: (a) fulfilling all agreed-upon sales in a timely manner; (b) packaging and shipping items securely; (c) handling returns in accordance with your stated return policy; (d) communicating clearly and promptly with buyers; (e) resolving any issues or disputes that may arise from transactions. Declutra is not responsible for any aspect of the transaction between you and a buyer.

6. Platform Fees

Declutra may charge platform fees on transactions completed through the marketplace. By using the marketplace as a seller, you agree to pay all applicable fees. The current fee schedule will be published on our website and may be updated from time to time with reasonable notice. Fee changes will not apply retroactively to transactions already in progress.

7. Account Standing

Declutra reserves the right to suspend or terminate your seller privileges at any time for: (a) violations of this Seller Agreement or the Terms of Service; (b) listing prohibited items; (c) excessive buyer complaints or disputes; (d) suspected fraudulent activity; (e) failure to fulfill agreed-upon sales; (f) any other conduct that Declutra determines is harmful to the marketplace or its users.

8. Limitation of Liability

Declutra is not liable for any losses arising from transactions between you and buyers, including but not limited to: buyer disputes, payment issues, shipping damage or loss, returns, chargebacks, or any other transaction-related losses. You assume all risk associated with selling items through the Declutra marketplace.

9. Changes to This Agreement

Declutra may update this Seller Agreement from time to time. We will notify sellers of material changes via email or a prominent notice in the seller dashboard. Your continued listing of items after changes become effective constitutes acceptance of the revised agreement. If you do not agree to the updated terms, you must cease listing items on the marketplace.
