Prohibited Items Policy

The following items are strictly prohibited from being listed on the Declutra marketplace. Listing any prohibited item is a violation of the Seller Agreement and Terms of Service, and may result in immediate account termination and referral to law enforcement where appropriate.
1. Weapons & Ammunition
Firearms, ammunition, explosives, firearm parts and accessories, brass knuckles, switchblades, throwing stars, and any other weapons regulated or prohibited by federal, state, or local law. This includes replica or deactivated weapons that could be mistaken for functional weapons.
2. Drugs & Drug Paraphernalia
Illegal drugs, controlled substances, prescription medications, over-the-counter medications, drug paraphernalia, and any items marketed as legal alternatives to controlled substances. This includes but is not limited to narcotics, steroids, and performance-enhancing drugs.
3. Counterfeit & Stolen Goods
Counterfeit, fake, or replica items bearing trademarks without authorization; stolen merchandise; items with altered or removed serial numbers; and any goods that infringe on intellectual property rights including patents, copyrights, or trademarks.
4. Hazardous Materials
Hazardous chemicals, radioactive materials, flammable substances, toxic materials, pesticides, and any items classified as hazardous by the EPA, DOT, or other regulatory agencies. This includes items that require special permits or licensing for sale or transport.
5. Recalled Products
Any item that has been recalled by the manufacturer, the Consumer Product Safety Commission (CPSC), the Food and Drug Administration (FDA), or any other regulatory body. Sellers are responsible for checking recall databases before listing items.
6. Live Animals & Protected Wildlife
Live animals, animal parts from endangered or protected species, items made from ivory, products derived from protected wildlife, and any items prohibited under the Endangered Species Act, CITES, or the Lacey Act.
7. Tobacco & Alcohol
Tobacco products, electronic cigarettes, vaping devices and supplies, alcoholic beverages, and any items where the sale is regulated by federal, state, or local alcohol and tobacco laws. Vintage or collectible packaging that originally contained these products is permitted only if completely empty.
8. Adult & Obscene Content
Pornographic or sexually explicit materials, adult toys and devices, items used in connection with the sexual exploitation of minors, and any content that is obscene under applicable community standards.
9. Human Remains & Body Parts
Human organs, body parts, bodily fluids, blood products, and any human remains. Items made from human hair or teeth that are clearly vintage or antique and have cultural or historical significance may be permitted on a case-by-case basis.
10. Financial Instruments & Personal Information
Securities, stocks, bonds, gift cards without authorization from the issuer, virtual currencies or cryptocurrency mining equipment, personal information (Social Security numbers, financial account data, login credentials), and any items intended to facilitate identity theft or financial fraud.
Reporting Prohibited Items
If you encounter a listing that you believe contains a prohibited item, please report it immediately using the "Report Listing" button on the listing page or by contacting us at support@declutra.com. All reports are reviewed within 24 hours.
Enforcement & Consequences
Three-Strike Policy:
- First violation: Listing removed, formal written warning issued to seller.
- Second violation: Listing removed, 30-day suspension of seller privileges.
- Third violation: Permanent account termination and ban from the marketplace.
Declutra reserves the right to bypass the three-strike policy and immediately terminate accounts for severe violations, including but not limited to listings involving illegal items, items that pose a safety risk, or items related to the exploitation of minors. Declutra may also report violations to law enforcement authorities where appropriate.
